Compost Direct – Conditions of Sale

1. General

In these conditions of sale:
The company means Compost Direct Ltd.
Correspondence address: Fold Farm, Galley Lane, Barnet, Herts, EN5 4RA.
The customer means any person contracting with the company for the supply of products or services.
Delivery means delivery by the company or any subcontractor employed by the company directly or indirectly.
These conditions may only be modified by a variation in writing signed on behalf of the company by a Partner.??Submission of a purchase order online will be taken as agreement to these conditions of sale.

 

2. Supply of Products

Products are sold under the express understanding that:

The customer and the company are contracting in the course of their respective business and except as stated in writing by the company no condition or warranty is given or implied by law, custom, usage or otherwise as to the quality or fitness for any purpose of the goods sold by the company.
We cannot guarantee that the appearance and/or colours of products shown on this site exactly reproduce the appearance and/or colours of the physical products themselves. Natural products may show some colour variations. All sizes quoted are approximate.
The customer understands that products are measured when packed and due to the nature of the products a degree of settlement will occur.

The customer understands that turf is a growing crop and therefore is an everchanging product and is dependant on the conditions in its growing environment. The customer understands that turf is a perishable product which must be laid on properly prepared topsoil. Once delivered, the turf must be rolled out and laid within a maximum of 2 hours and must be watered adequately to encourage rooting.

The customer understands that the materials are measured by a certified loading bucket which is stamped and measured by Trading Standards, and not by the dimensions of the bag it is delivered in.

The company require any complaint to be made in writing by the customer within 48 hours of collection or delivery via our contacts page.
If the customer is dissatisfied with the product then it must be returned to the company within 5 working days after the complaint has been logged. A refund will then be made for the original purchase price.
All prices quoted by the company include the cost of delivery, unless otherwise stated.
Customers are required to pay by credit card/debit card at the time of ordering.
Prices quoted are inclusive of VAT and include standard delivery of usually 3-4 working days, unless otherwise stated. There are additional charges for next day and weekend deliveries.
All items shall be at the customers risk from the time of delivery. After such time, the company shall be under no liability for loss, damage or deterioration of items from whatever cause arising.

 

3. Delivery

The company will make every effort to deliver on the agreed date, but if for any reason the company is unable to deliver then there will be no liability whether in damages or otherwise for delay of whole or any part of the goods ordered arising from any cause whatsoever. ??Delivery by the company shall be conditional upon access free from encumbrances and good roads being available to the delivery vehicles to the place of delivery. ??The company will not accept any liability for damages to property caused during delivery. ??If the company, or its agent cannot gain access to the delivery address then additional costs may be incurred. Deliveries are made using large vehicles with loading cranes and it is the customers responsibility to inform the company if there may be an access problem. Specifications for area required for unloading is stated on the delivery information page on the company website. 

The customer understands that delivery onto a driveway is at the driver’s discretion and the customer therefore agrees that the driveway is capable of withstanding the weight of at least 1 tonne, or at least 18 tonnes if it is necessary for the unloading vehicle to drive onto the property to offload bags.

If the customer requests delivery to somewhere other than kerbside then they must be aware that this may not be possible and that they must take kerbside delivery in the face of this. The company will not accept damage to property caused during delivery whereby the customer has instructed drivers for goods to be placed anywhere other than kerbside.

The customer understands that the company can only guarentee delivery to kerbside or roadside and that ultimately they are happy for goods to be left in this manner.

The company vehicles do not drive across fields or unmade roads. If the customer wishes to have delivery across a field then they will become liable for any damage made to the vehicle. If the truk becomes stuck when crossing the field etc under the customers instruction, then the customer must arrange to have the vehicle recovered immediately, at their cost. The cost of a vehicle being held up in this manner will be charged to the customer at a rate of £50+VAT per hour.

If a customer wishes for any vehicle to leave the public highway and enter their property or premises of delivery then the customer accepts liability for any damages caused to the property, vehicle or other. If the company or its agent cannot gain access to the delivery address then additional costs may be incurred and shall ultimately fall to the customer. Deliveries are made using large vehicles and it is the customer's responsibility to inform the company if there may be an access problem. The company will confirm the outcome by e-mail. In such cases that delivery, in the opinion of the company is not possible, then the company reserves the right to cancel the order. This above action must be completed before 2.00 pm on the day prior to delivery.

E-mail confirmation of orders also request the customer to contact the company if a delivery problem may occur.

Delivery vehicles mostly use tail lift offloading. The delivery vehicle must be able to park in an area where the delivery is to be made; they cannot park in any red zones or on restricted parking. In the case of our tail lift (kerb or road side) offloading vehicle a pallet truck is then used to manoeuvre the items off the tail lift to the kerbside delivery point. 

The customer understands that, as kerb or road side deliveries are made using a manually manoeuvred pump truck, it is not possible to leave goods on uneven surfaces such as gravel, grass or on hills or slopes of any kind.

It is also not possible to lift goods over any walls, fences, hedges etc. Crane offload is available in London and most of the Home Counties. Delivery areas are determined by post code zones, please check these on our delivery information page. We reserve the right to change these without prior notice.

The company reserves the right to cancel or hold any orders that the company deems may suffer from potential delivery problems and the customer understands that delivery dates may be delayed in these instances.

 If products are out of stock then the company also reserve the right to cancel or hold delivery of orders in this situation.

 If delivery is attempted and deemed not possible due to lack of information provided by customer, or customer’s failure to read or consider delivery information and restrictions then the customer will become liable for re-delivery charges and/or re-routing costs.

These costs are £35 + VAT per pallet/bulk bag.

The customer agrees to accept responsibility to provide a suitable area free from access restrictions for the delivery to be left. It is the customers responsibility in some areas of the UK to obtain a permit from your local council to have bulk bags left on the kerbside.

Loose loads of product are delivered on a vehicle with a gross vehicle weight of 32 tonnes or more, depending on the load size. It is therefore the customers responsibility to find a suitable delivery point for products to be tipped off in this instance.
The customer, or somebody appointed by the customer, should be at the delivery point to accept the delivery.

The company reserves the right to cancel or hold any orders that the company deems may suffer from potential delivery problems and the customer understands that delivery dates may be delayed in these instances.??If products are out of stock then the company also reserve the right to cancel or hold orders in this situation.

 

4. Cancellation/Returns Policy

The customer has the right to cancel any product or services at any time up to 7 working days, starting after the day of dispatch. If you cancel your order within 7 working days of dispatch, you will be issued a full refund once the goods have been returned to the company, at your cost, as per the Distance Selling Regulations.

Once the company has dispatched the goods, it will be the customers repsonsibility to return the goods at their cost, should they wish to cancel their order.

 

5. Order Amendments

Any order amendments must be made before goods are despatched, despatch may be up to 5 working days prior to delivery. We are unable to amend orders after despatch.

 

6. Company’s Premises

The customer will at all times be responsible for the security and insurance of the products after the delivery has been made.
The customer will comply with all requirements of Health & Safety Legislation.
Delivery will be made on a kerb side delivery basis and will be the customers responsibility to move the compost, soil, turf etc from the place of delivery to the area of use.
The company accepts no responsibility for injury or damage caused to persons or equipment whilst on company premises.

 

7. Working Days

Working days are Monday, Tuesday, Wednesday, Thursday, Friday. Saturday and Sunday are not working days.
These conditions and any contract or variation are governed by the law of England. Any disputes arising from these conditions or any contract or variation entered into by the company with the customer which cannot be settled in the ordinary course of business shall be referred to a single arbitrator in accordance with the arbitration act 1950 or any modification thereof for the time being in force.??This policy does not affect your statutory rights.

 

8. Privacy

The company does not store financial details (credit or debit card numbers).
